The following results are based on the fast affiliate ratings (Live Plus Same Day data)

-Total Viewers:
NBC: 9.31 million, CBS: 9.20, ABC: 8.00, Fox: 7.97, CW: 2.34

-Adults 18-49:
NBC: 3.0 rating/8 share, Fox: 2.8/ 8, ABC: 2.6/ 7, CBS: 2.1/ 6, CW: 1.0/ 3

Note: Any prior rating results are based on the final nationals. Also, since the level of DVR penetration has increased from 9 percent in early 2006-07 to approximately 20 percent at present, the overall results may be negatively impacted.

-Ratings Breakdown:
NBC won this uneventful Tuesday, with a first-place finish in both total viewers and adults 18-49. CBS was second in total viewers and fourth in the demo; Fox was just the opposite, and ABC finished third. Last, of course, was declining the CW.

A repeat of CBS’ NCIS was first in the 8 p.m. hour in total viewers, but a repeat of ABC holiday special Shrek the Halls won the 8 p.m. half-hour among adults 18-49. The NCIS encore averaged 11.77 million viewers, with a third-place finish among adults 18-49 (2.5 rating/7 share). Shrek the Halls scored a dominant 3.4/10 in the demo, with 9.97 million total viewers (#3). Leading out of the Shrek the Halls encore was a repeat of A Winnie the Pooh Christmas at 8.55 million viewers (#3) and a 3.1/ 9 among adults 18-49 (#2) at 8:30 p.m.

NBC was on the map at 8 p.m. care of Deal or No Deal at a healthy (and second-place) 11.33 million viewers and a 3.1/ 9 among adults 18-49. Also occupying the hour was a repeat of Fox’s Bones (Viewers: #4, 6.20 million; A18-49: #4, 2.0/ 6), and a repeat of America’s Next Top Model on the CW (Viewers: #5, 1.75 million; A18-49: #5, 0.8/ 2).

NBC moved into the 9-10 p.m. winner’s circle, with The Biggest Loser above average at 9.84 million viewers and a 3.6/ 9 among adults 18-49. A close second was a repeat of Fox’s House at 9.74 million viewers and a 3.5/ 9 in the demo. Also in the hour was the first of two back-to-back episodes of CBS’ Cane (Viewers: #3, 8.00 million; A18-49: #3t, 1.9/ 5), two repeat episodes of ABC’s critically challenged According to Jim (Viewers: #4, avg. 5.74 million; A18-49: #3t, 1.9/ 5), and a repeat of The Victoria’s Secret Fashion Show on the CW at 2.94 million viewers and a 1.3/ 3 among adults 18-49. Although Cane could certainly be doing worse, lack of interest among key adults 18-49 means that the axe is getting ready to swing.

Does anyone, meanwhile, even care that According to Jim is waiting in the midseason wings for a…gulp…seventh season? Why, ABC? Why?

ABC’s Boston Legal won the 10 p.m. hour, with 9.00 million viewers and a 2.5/ 7 among adults 18-49. Comparably, that built from the 9:30 p.m. According to Jim encore (Viewers: 5.52 million; A18-49: 1.8/ 5) by a hefty 3.48 million viewers and 39 percent in the demo. Tied for the No. 2 and 3 spots, respectively, was the regularly scheduled installment of CBS’ older skewing Cane (Viewers: #2, 7.83 million; A18-49: #3, 2.0/ 6) and a repeat of NBC’s Law & Order: SVU (Viewers: #3, 6.75 million; A18-49: #2, 2.4/ 6).

Deal, Biggest Loser both getting stronger with competition out of the way. And Cane did a little better than I was expecting, but is still not capturing enough demo to warrant a return to production.

The Boston Legal number is more like what I would expect between Dancings. I don't know what happened last week, but nice to see it rally a bit.

Those According to Jim numbers make Cavemen / Carpoolers look good. And Jim squandered away a very generous lead-in from the animated specials.

Good to see that Boston Legal overcame the handicap of its weak lead-in to win the hour in the young adult demo.

Surprising to see how well that Victoria's Secret special did, given that it was an encore from CBS just a few days ago. This is the first time CBS has re-purposed programming on The CW (it used to do it more often on UPN).

Goodbye Cane! Nice repeat numbers for Shrek and the usual number for Loser in that hour. Decent if unspectacular number for Boston (especially with that lead in).

I think it's funny that a repeat of The Victoria's Secret fashion show out did what Reaper usually does in that time slot. That sucks.

Good to see BL do so well out of what was pure crap airing before it (and no, not bashing the show, just talking about the numbers). Nice to see the audience pick up, despite the show not doing so well last week.

I think, though, 9mil/2.5 demo is about as good as the show will do with the remaining episodes it has before the strike halted production. I think they have 5 or so left (including one just filmed with guest-star Scott Bakula).

I'm surprised to see Cane doing 8 million and 2.0 in demos. That's better than the last couple of episodes and that's when every show actually does worse than usul. Of course this won't save it but i find it curious
I also want to applaud CBS this time for respecting their viewers beacause although the strike looks far from resolvable they air some of their highest rated shows (CSI, CM) according to the original programming and they're not saving the last episodes filmed for God knows when. I cannot say the same for FOX and especially ABC which are tottaly disrepectful of their viewers. Who knows when the last filmed episodes of GA or DH will be aired. Shameful

So were those the last orginal episodes of CANE-the probable series finale?

Don't forget season finale of KID NATION airs tonight. According to MEDIA LIFE it may yet live to see a Season 2

(was going to add a link but annoyingly there is no PASTE feature on our board here and the URL is too long to remember-maybe the Web Master can do something about that).

Anyway it would make sense given the strike rather than CBS trying to create some all new reality show when now KID NATION would have name recognition.

Finally What the hell with ABC...are they becoming the CARTOON NETWORK...it's really getting a little ridiculous airing repeats from within the last two weeks and all.

The bad thing from ABC is not that tehy air many cartoons but the fact they air mainly repeats of cartoons. Why don't they start producing more original cartoon episodes?
