The following results are based on the fast affiliate ratings (Live Plus Same Day data)

-Total Viewers:
NBC: 11.84 million, Fox: 8.60, CBS: 8.09, ABC: 4.35, CW: 3.47

-Adults 18-49:
NBC: 4.6 rating/12 share, Fox: 2.8/ 7, CBS: 1.9/ 5, CW: 1.5/ 4, ABC: 1.3/ 3

Note: Any prior rating results are based on the final nationals. Also, since the level of DVR penetration has increased from 9 percent in early 2006-07 to approximately 20 percent at present, the overall results may be negatively impacted.

-Ratings Breakdown:
Led by a season-high performance for Law & Order: SVU, NBC dominated this second Tuesday of 2008 in both total viewers and adults 18-49. Second was Fox, followed by CBS. The CW actually finished the evening fourth among adults 18-49, two-tenths of a rating point (or 15 percent) above cellar-dweller ABC.

Another two-hour edition of The Biggest Loser 5 opened the evening for NBC with a first-place finish overall in total viewers (10.18 million) and adults 18-49 (4.3 rating/11 share) among adults 18-49, building in each half hour as follows:

The Biggest Loser 5 (NBC)
8:00 p.m. Viewers: 8.48 million (#2), A18-49: 3.4/ 9 (#1)
8:30 p.m. Viewers: 9.32 million (#2), A18-49: 3.9/10 (#1)
9:00 p.m. Viewers: 10.80 million (#1), A18-49: 4.6/11 (#1)
9:30 p.m. Viewers: 12.13 million (#1), A18-49: 5.2/13 (#1)

Next on NBC was veteran Law & Order: SVU, with a very dominant 15.17 million viewers and a 5.1/14 among adults 18-49 at 10 p.m. That was the highest rated show of the evening.

Fox aired repeats of Bones (Viewers: #3, 6.40 million; A18-49: #3, 2.0/ 5) and House (Viewers: #2, 10.80 million; A18-49: #2, 3.6/ 9) last night and still managed to finish second overall. Yes, that’s impressive.

The ongoing writers strike continues to create chaos in prime-time, with an absolutely awful taped version of The 34th Annual People’s Choice Awards plummeting to a historically low 6.00 million viewers and a 1.6/ 4 among adults 18-49 from 9-11 p.m. Take a look at the erosion in every half-hour:

The People’s Choice Awards (CBS)
9:00 p.m. Viewers: 7.86 million (#3), A18-49: 1.9/ 5 (#3)
9:30 p.m. Viewers: 6.34 million (#3), A18-49: 1.6/ 4 (#3)
10:00 p.m. Viewers: 5.33 million (#2), A18-49: 1.5/ 4 (#2)
10:30 p.m. Viewers: 4.45 million (#2), A18-49: 1.3/ 4 (#2)

Comparably, this was a loss of a massive 5.33 million viewers and 54 percent among adults 18-49 from the year-ago telecast (Viewers: 11.33 million; A18-49: 3.5/ 9 on Tuesday 9, 2007). And all the more reason to get this damn writers strike settled already!

Earlier in the evening, CBS kicked-off with a repeat of NCIS at 12.27 million viewers (#1) and a second-place 2.4/ 6 among adults 18-49.

ABC had nothing of note to report with its lackluster combination of Just For Laughs (Viewers: #3, 6.44 million; A18-49: #4, 1.8/ 5), coverage of the New Hampshire Primary (Viewers: #4, 5.00 million; A18-49: #4, 1.6/ 4), According to Jim (Viewers: #4, 4.52 million; A18-49: #4, 1.2/ 3), the return of Carpoolers (Viewers: #4, 3.54 million; A18-49: #4, 1.1/ 3), and a repeat of Cashmere Mafia (Viewers: #3, 3.31 million; A18-49: #3, 1.0/ 3). Wasn’t it just great to have Carpoolers back? Yes…I’m kidding, folks!

Over at the CW was the season-premiere of One Tree Hill (Viewers: #5, 3.36 million; A18-49: #5, 1.5/ 4), followed by a second episode at 3.59 million viewers (#5) and a 1.6/ 4 among adults 18-49 (#5) at 9 p.m. One year earlier, One Tree Hill (out of America’s Next Top Model) opened the season with a similar 3.44 million viewers and a 1.7/ 4 in the demo on Wednesday, Sept. 27, 2006. Considering it had no benefit of any lead-in support, the results could have been worse.

And why did they even broadcast the People's Choice Awards. It was painful to watch. I felt sorry for Queen Latifah. I also dont understand why the winners can prerecord acceptance speeches, but no go to the awards. ???

Really good numbers for OTH, abysmal numbers for ABC

Next week will be decisive for OTH. If it remains around 3.5 million that's great news fro CW

prolly due to a strong lead in by loser.

several observations:
1) Damn, the WGA must be pretty pissed since they've been targeting NBC and it seems NBC is just getting all the luck with their programming, no incentive to settle.
2) Is it possible that we'll be seeing more Reville productions on NBC? Ben Silverman could be playing favourites but look at the results, Gladiators, Loser and Office are doing big business here.

I think SVU's numbers come from a lack of anything watchable on the other networks.

The poor Cashmere Mafia repeat numbers cannot bode well for a showing tonight against a new Law & Order and a new CSI:NY.

Marc, with this kind of strength, don't you think that you should finally give The Biggest Loser its own forum like every other show?

Enjoyed the Bones pilot, but turned off the House pilot 20 minutes in. Was shocked by the shoddy production -- the lighting was awful, the dialogue lame. (I just really started watching House regularly this fall.)

Well, nothing on ABC repeats well, so I don't think that necessarily says much. However, it didn't exactly get a warm reception after its first run. The general consensus I've seen is, “It’s bad, but there’s nothing else on." I can’t see it doing very good numbers against two new episodes, even if they are both procedural crime shows.

Above 3.25million is good. The fact that it built on itself in the second hour might be an indication that the viewers prefer it to be on later in the evening. Then again, maybe it is just the nature of CW Tuesdays since Reaper frequently built on B&tG?
