The DGA and AMPTP have come to an agreement according to the Hollywood Reporter.

-- Residual rates for ad-supported streaming and use of clips on the Internet.

Key new-media provisions appear substantial.

The agreement more than doubles the current residual on downloads of TV programming and boosts film residuals on downloads by 80%, officials said. A roughly $600 payment for ad-supported streaming kicks in after the first 17 days of streaming, followed by additional payments after 26 weeks totaling $1,200 for a year's worth of streaming.

"Two words describe this agreement -- groundbreaking and substantial," said Gil Cates, chair of the DGA's Negotiations Committee, in announcing the terms of the new agreement. "The gains in this contract for directors and their teams are extraordinary -- and there are no rollbacks of any kind."

The WGA, which launched since-aborted talks with the AMPTP on July 16, has been out of contract since Oct. 31 and on strike since Nov. 5. The AMPTP has refused to negotiate further with the writers since Dec. 7, when it demanded the WGA remove demands including reality-TV and animation jurisdiction and the right to stage sympathy strikes.

There was no immediate comment from the WGA on news of the DGA-AMPTP agreement.

Agreed. Those wrestling fans are a 'cult', but if they found MNTV the show could set a ratings record.


MyNetworkTV did beat The CW on Thursday January 3, 2008 in the demo (0.90 to 0.85), and MyNetworkTV did indeed exceed The CW last night in viewers, averaging 1.4 million in the 8-9 pm hour for "Whacked Out Videos", and 1.4 million in the 9-10 pm hour with the "Exposed Pro Wrestling Secrets Revealed" special.

So far in 2008, in seven nights of head-to-head competition, it is:
  • The CW - 4 fifth places
  • MyNetworkTV - 3 fifth places

FYI, summary details on the DGA deal can be found here.

It's definitely a starting point for the WGA. That the DGA got Distributor's Gross terms as well as access to the financial data in order to monitor the payments... that's really, really huge. And also two of the things the AMPTP told the WGA would have to be taken off the table for negotiations to continue on December 7th.

Though I'm sure there's plenty of fine print to be analyzed that the public hasn't been given access to yet.

Are the residuals for downloads given:

1) As a percentage of Gross
2) On a "per download" Basis
3) as a lump sum per year?

Also, even though "Crowned" tanks in the ratings, it's really worth catching the last 10 minutes of this week's episode. Not since "All in the Family" has a domestic sound been so aptly used.

As far as I can tell, residuals for downloads are paid (1) as a percentage of gross. The streaming (i.e. hulu.com, network websites, etc) payments seem to be (3) as a lump sum (though not necessarily per year).

I doubt we'll even hear anything until tomorrow from the WGA about their analysis of the DGA terms. AMPTP has to come back to the table. They're free to now that they're done with the DGA and the studios have cut loose / force majeured overalls. I hate to make predictions, because it only serves to get my own hopes up, but I say this thing is done before the Oscars because there's real incentive for the studios to save that show.
