I remember discussing this show with a few folks here a few days ago but can't find the thread. I wanted to post an update, as several of us were excited about this show and were wondering if it would get picked up by ABC, as it is one of a few ABC projects/pilots that shows promise. Well, in fact the project is further along than I thought, it in fact has a 6 episode blind-order commitment to series, which means that this Lloyd Braun project is hopefully going to compete for a spot on ABC's schedule for 2008-09.
Here's the description of Section 8 from thefutoncritic:
Feature writer Zak Penn ("X-Men: The Last Stand") has been issued a six-episode order for a new drama about a team of everyday people with advanced neurological abnormalities who work for a secret government agency. Said moniker comes from the clause used for discharge from the U.S. Army because of mental issues. Penn co-created the hour with Michael Karnow and will executive produce alongside BermanBraun's Lloyd Braun and Gail Berman. Karnow then will serve as a producer with the project itself based at ABC Studios. It's understood Penn secured the order following a well received presentation which included special effects-enhanced video of what one of the characters on the show would look like: a guy with perfect balance who throws a roll of 10 quarters that land in 10 cups of water.

I agree that it should be very compatible with LOST. Like many here, I also have high expectations for Eli Stone (I think LOST and Eli Stone may be the only shows on ABC that benefit from the strike), so I expect Eli Stone to return next season. So I envision a lineup of:
8pm Section 8 9pm LOST 10pm Eli Stone
It would very likely be back on Wednesdays next season when everything hopefully returns back to normal.

I don't see how they can be sued -- it's like suing someone for using the term 'schizophrenia' or something. 'Section 8' refers to a specific section of military code dealing with discharging folks due to mental issues. I don't think the video game is the same thing, just happens to be named the same thing...
